Merci Maman (“Merci Maman,” “we”, or “us”) respects your privacy.   1. What Personal Information Does Merci Maman Collect?

In general, the third-party service providers we use will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. We take reasonable precautions and follow industry best practices to protect your personal information, and to prevent your information from being lost, misused, accessed, disclosed, altered or destroyed. In particular, the system does not store or log a plaintext representation of your password. Merci Maman never logs or stores your credit card information as this information is transferred directly from your device to our payment processor, Square, and only returns a random identifier linking to the credentials stored on Square’s server. Your data is encrypted by Square in accordance with the Payment Card Industry Data Security Standards (PCI-DSS). Please note that the electronic transmission of information is not 100% secure. We cannot guarantee that the security measures we have in place to safeguard personal information will never be defeated or fail, or that such measures will always be sufficient or effective. Any transmission of personal information is at your own risk.

Merci Maman reserves the right to modify this Privacy Policy at any time, so please review it periodically to check for any updates or changes. Changes and updates will take effect immediately upon their posting on the website. If we make material changes to this policy we will notify you via email and by posting a notice on our website, so that you are aware of such changes. In the event we make a material change to how we use your personal information, we will provide you with an opportunity to opt out of such new or different use. Merci Maman is based out of Los Angeles in the United States. When we obtain information about you, we may transfer, process, and store such information outside of the country in which you reside, including in the United States. By using the Services, you consent to the transfer and processing and storage of your information in countries outside of your country of residence, which may have different data protection laws than those in the country where you reside.

Exercising Access, Data Portability, and Deletion Rights

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us, but we may require authentication of the consumer that is reasonable in light of the nature of the personal information requested.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (for a maximum total of 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the receipt of a verifiable consumer request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless the request is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. Alternatively, we may decline to respond to the request and notify you of our reason for doing so.

 

Other California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
